GDPR text box should allow for a toggle to make checking the box mandatory for list sign ups.

The same thing happens to me. And I don't understand why Simplero doesn't allow the check box to be mandatory. The other platforms I've used did allow it.
In the end, what I've done is put a check box on the forms with the same text and make it mandatory. And force manual consent one by one.
But it's not sustainable. Because then you don't have proof that the person has given consent.
I will open another petition asking that we can choose whether the check box is mandatory or not. At least in Spain, it is legal to do so.

Lene Steinke You can make GDPR mandatory at the Account settings level > Privacy section.
Is that what you were looking for?
When you have that setting enabled, anyone signing up to your lists will be required to accept GDPR before signing up to your lists.
You can skip the GDPR requirement at the List > Configure level if you'd like to have lists outside of this requirement.

Lene Steinke: When GDPR consent is set to be required on your account settings. Leads won't become subscribers unless they agree to GDPR.
Meaning that submitting a signup form and not checking the GDPR box, will lead them to the page linked below, where they are informed they won't receive any content unless they give GDPR consent. That includes starting automations from the list subscription.
I'm not sure I understand what your expectation is here.
If you would like to provide leads who haven't given GDPR consent to receive the freebie content, you can do that by adding the content to the welcome email (Day 0 auto-response), on the Thank you page, or in the list freebie section. Anything added to those places will be delivered regardless of their GDPR response.
